Unique in the Scottish legal market place, the Bell & Scott Strategic Land Team was brought together to provide legal advice and support to this growth area within the development industry. As our developer clients find it more and more difficult to acquire sites with the benefit of planning consent, and increasingly seek to do deals which take a longer term view, we have recognised the need to provide a team of lawyers with extensive experience in the issues surrounding strategic land deals. Very quickly, the team has gained a widely recognised reputation within this highly specialised area. Other law firms undertake strategic land work; only Bell & Scott provides a team that works exclusively in this area. This specialisation gives a genuine understanding of the issues; be they contractual, planning or practical.

Our experience is also sought by landowners wishing to enter into deals with developers in a way that will unlock maximum value, and allow them to profit from the future development value of their land.

As well as drafting and negotiating agreements for the acquisition, promotion and disposal of land, the team is building a strong reputation for its work on Section 75 and other planning agreements, gaining instructions from new clients attracted to the firm by this particular specialisation.

Typically, the projects handled by the Bell & Scott Strategic Land Team are highly complex, with no two being the same. We devise and adapt structures which generally involve a long term arrangement, the sharing of risk, reward and profit, promotion through the planning process, perhaps a brown field aspect and often an element of site assembly. All of this is handled by a team of lawyers who enjoy being at the heart of our clients’ transactions.
